ORDER

This matter is an appeal from the Election Supervisor’s decision 2006 ESD 87 issued February 22, 2006.

A hearing was held before me on March 3, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. and Steven Newmark, Esq. on behalf of the Election Supervisor, Ross Peterson, Don Davies, and Don Evans all members of Local Union 31 and Barb Evans.

In light of newly presented evidence, and upon agreement of all parties at the hearing, the matter is remanded to the Election Supervisor for further review and investigation.
