Mike Schaffer, a member of Local Union 377, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2000-2001 IBT International Union Delegate and Officer Election ("Rules") against the Hoffa 2001 campaign. On August 1, 2000, we issued our decision in 2000 EAD 8, finding a violation of the Rules.

On August 3, 2000, the Hoffa 2001 campaign filed an appeal of the decision in 2000 EAD 8 with the Election Appeals Master. In that appeal, the campaign requested a stay of "that portion of the Election Administrator's decision that requires our client to fax signed copies of notices to Local Unions across the country…" The stay was sought pending the Election Appeals Master's consideration of the appeal. As of this writing, no ruling on the stay request has been received from the Election Appeals Master.

On August 7, 2000, at 2:37 p.m., the Hoffa 2001 campaign (in a letter misdated August 4, 2000) requested a stay of the decision in 2000 EAD 8 from the Election Administrator. This stay request is not limited in scope, as is the stay request made to the Election Appeals Master. Instead, the campaign seeks a stay by the Election Administrator of the decision in its entirety.

We grant the stay only to the extent requested from the Election Appeals Master. That is, we stay only "that portion of the Election Administrator's decision that requires [James P. Hoffa] to fax signed copies of notices to Local Unions across the country." This stay shall remain in effect until the earlier of 4:00 p.m., Thursday, August 10, 2000, or the issuance of a ruling by the Election Appeals Master on the Hoffa 2001 campaign's August 3, 2000 stay request, without prejudice to a further request for extension of this stay.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Administrator in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
