DECISION CORRECTION

Gentlemen:

 

In the Decision issued in the above-referenced case on May 13, 1999, there was an error on page 10 in the remedy involving Chuck Crawley. A corrected page 10 follows:

 


Therefore, the Election Officer orders the following:

 

A.               Ken Hilbish

 

1.  Mr. Hilbish shall immediately cease and desist from threatening retaliation against any employee of Local 528 based upon activity protected by the Rules.  

 

2.  By May 15, 1999, Mr. Hilbish shall have the attached “Notice to Local Union 528 Members and Employees” posted at the local union office.  By May 17, 1999, Mr. Hilbish shall post the attached “Notice to Local Union 528 Members and Employees” on all bulletin boards at Local Union 528 work sites.

 

3.  Mr. Hilbish must submit an affidavit to the Election Office, on or before May 20, 1999, attesting to the local union’s compliance with this order. 

 

 

B.               Chuck Crawley

 

1.  Mr. Crawley shall immediately cease and desist from threatening retaliation against any IBT member based upon activity protected by the Rules.  

 

2.  By May 15, 1999, Mr. Crawley shall have the  attached “Notice to Local Union 988 Members and Employees” posted at the Local Union 988 office.  By May 17, 1999, Mr. Crawley shall post the attached “Notice to Local Union 988 Members and Employees” on all bulletin boards at Local Union 988 work sites.

 

3.  Mr. Crawley must submit an affidavit to the Election Office, on or before May 20, 1999, attesting to the local union’s compliance with this order. 

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one (1) day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
