            On January 30, 2026, the Election Supervisor issued his decision in Richardson, 2026 ESD 33 (Jan. 30, 2026) (the “Decision”) finding that the facts were largely undisputed including that protestor, Pamela Richardson, admitted that she was unaware of the use of the subject tents during Local 767’s delegate election. Thus, no violation of the Rules was found. Richardson appealed the Decision, and an appeal hearing was scheduled for February 6, 2026. However, Richardson’s explained that the basis for her appeal was that after the investigation concluded and the Decision was issued, she obtained new evidence allegedly in support of her allegations. Based on the specific facts and circumstances presented here, we find that new evidence has been presented that warrants further investigation. Accordingly, we stay our determination in the Decision pending the completion of our investigation of the new evidence. See In re Hoffa-Hall 2011, 2011 ESD 167 (Mar. 20, 2011) (staying the Election Supervisor’s findings and remedial order pending completion of investigation of new evidence submitted after the issuance of the decision); see also Acosta, P-961-LU287-CSF (Oct. 29, 1996) (withdrawing decision after issuance and before scheduled appeal hearing to consider new evidence).

APPELLATE RIGHTS

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. Any party requesting a hearing must comply with the requirements of Article XIII, Section 2(i). All parties are reminded that, absent extraordinary circumstances, no party may rely in any such appeal upon evidence that was not presented to the Office of the Election Supervisor. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
