PROCEDURAL HISTORY

            On February 28, 2026, Local 63 hosted a general membership meeting. At that meeting, General President Sean O’Brien spoke about Randy Cammack and Sam Stewart, candidates on the Cammack/Stewart OZ Teamsters United 2026 Slate. Following the meeting, Rosemary Stedronsky filed a protest against O’Brien claiming, in relevant part, that O’Brien improperly engaged in campaign speech for the Cammack/Stewart OZ Teamsters United 2026 Slate.

On May 27, 2026, the Election Supervisor issued a consolidated decision concerning P-100-030326, P-101-030326, and P-102-030326, Stedronsky, 2026 ESD 91 (May 27, 2026), denying the protests in their entirety. Stedronsky timely appealed. An appeal hearing was held before the Appeals Master on June 12, 2026. Following the hearing, the Appeals Master issued an order finding that O’Brien’s speech at Local 63’s general membership meeting violated Article VII, Section 5 of the 2025–2026 IBT International Union Delegate and Officer Election (“Rules”), which requires that, if a local union allows campaigning during a union meeting, it must provide an equal opportunity to all candidates or their representatives. Specifically, the Appeals Master found that the substance and timing of the speech, which coincided with the distribution of a campaign postcard, support the conclusion that this was campaign activity under the Election Rules. The Appeals Master affirmed the Election Supervisor’s determination that the conduct complained of did not affect the outcome of the election and this determination shall not prevent the seating of delegates at the upcoming IBT Convention or otherwise prevent the nomination of candidates during the Convention but remanded the Election Supervisor’s decision to issue an appropriate remedy for the improper campaign speech. All other claims on appeal were denied.

We issue this order pursuant to the Appeals Master’s order.

REMEDY

Article XIII, Section 4 of the Rules provides that when the Election Supervisor determines that the Rules have been violated, the Election Supervisor “may take whatever remedial action is appropriate.” The Election Supervisor’s discretion in fashioning an appropriate remedy is broad and is entitled to deference. Hailstone & Martinez, 10 EAM 7 (Sept. 14, 2010). Where violations have occurred, orders to cease and desist, post notices and attest to compliance are all appropriate remedies. Johnson, 2025 EAM 2 (Nov. 4, 2025).  Accordingly, to remedy O’Brien’s violation of the Rules by campaigning at Local 63’s membership meeting without advance notice that such campaign activity would take place, and pursuant to the Appeals Master’s decision issued on June 12, 2026, we HEREBY ORDER the following:

Within 24 hours of the issuance of this decision, Local 63 shall post the notice attached hereto on homepage of the Local 63 website in a font no smaller than size 12 font and shall keep that notice posted for thirty days. Within two days of the issuance of this decision, Local 63 shall certify to the Election Supervisor that the required notice has been posted.

APPELLATE RIGHTS

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. Any party requesting a hearing must comply with the requirements of Article XIII, Section 2(i). All parties are reminded that, absent extraordinary circumstances, no party may rely in any such appeal upon evidence that was not presented to the Office of the Election Supervisor. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:

Copies of the request for hearing must be served upon the parties, as well as upon the Election Supervisor for the International Brotherhood of Teamsters. NOTICE TO ALL MEMBERS OF IBT LOCAL 63 PER ORDER OF THE ELECTION SUPERVISOR

            The Appeals Master has found that General President Sean O’Brien campaigned at Local 63’s general membership meeting in violation of Article VII, Section 5 of the 2025-2026 International Brotherhood of Teamsters International Union Delegate and Officer Election (“Rules”), which requires that, if a local union allows campaigning during a union meeting, it must provide an equal opportunity to all candidates or their representatives. Specifically, the Appeals Master found that the substance and timing of the speech, which coincided with the distribution of a campaign postcard, support the conclusion that this was campaign activity under the Election Rules.

            As a result of the Appeals Master’s findings, the Election Supervisor ordered Local 63 to post, within 24 hours of the issuance of this Decision, this notice to all members of Local 63 on the homepage of its website to notify all members of O’Brien’s violation of the Rules and certify its compliance with the Election Supervisor’s order.
