ORDER AND ORDER TO SHOW CAUSE

The Fearless Slate, a slate of candidates for International Officer positions for the International Brotherhood of Teamsters, has been required during the period of their candidacy to comply with the campaign contribution and expenses reporting provisions of Article XI of the Rules. The Fearless Slate submitted the CCER Report and Supplemental Report No. 1 for Reporting Periods #2 and #3.[1]  Since that time, the Fearless Slate has failed to submit these reports for Reporting Period #4 and Reporting Period #5.[2] The Fearless Slate was granted a short extension of time to file Period #4 reports, however, that extension has since lapsed. No such extension for Period #5 was requested. Despite repeated efforts by the Office of the Election Supervisor (“OES”), the Fearless Slate has failed to timely submit these reports for Period #4 and Period #5. Timely submission of these reports is necessary in order to assess compliance with the raising and expenditure of campaign funds by the Election Supervisor as well as by accredited candidates for International office who are permitted access to the filed reports of other candidates, whether they are allied or in opposition.

IT IS ORDERED that, no later than Wednesday, October 7, 2026, The Fearless Slate shall submit the CCER Report and Supplemental Report No. 1 for reporting Periods #4 and #5, for which they are past due.

In addition, the Fearless Slate is ORDERED TO SHOW CAUSE by Wednesday, October 7, 2026, why the Election Supervisor should not assess the slate monetary fines on account of the delinquent CCER reporting.  See Delinquent CCER Reports of Chris Silvera, 2021 ESD 124 (June 10, 2021), and Delinquent CCER Reports of Chris Silvera 2021 ESD 128 (June 19, 2021) (discussing Hoffa-Hall 2016, 2016 ESD 158 (April 1, 2016) (the Election Supervisor has imposed fines for tardy filing of CCER reports).

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. Any party requesting a hearing must comply with the requirements of Article XIII, Section 2(i). All parties are reminded that, absent extraordinary circumstances, no party may rely in any such appeal upon evidence that was not presented to the Office of the Election Supervisor. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:

Copies of the request for hearing must be served upon the parties, as well as upon the Election Supervisor for the International Brotherhood of Teamsters.  Service may be accomplished by email, using the “reply all” function on the email by which the party received this decision. A copy of the protest must accompany the request for hearing.
