            Michael Sparks, member of Local 399, filed four protests alleging various violations against the Hollywood Teamsters United slate including the unequal access and misuse of union credentials and against Shop Steward Richy Gonzalez for ballot tampering and abuse of his authority. Deborah Schaaf investigated these protests.

            All of these protests arise in connection with a local officer election, which the protestor acknowledges. The Election Supervisor has no jurisdiction over local union elections. Jordan, 2001 EAD 76 (January 3, 2001); Collett, 2000 EAD 66 (December 19, 2000); Hale, 2000 EAD 61 (December 12, 2000); Weronke, P867 (August 19, 1996); Bishop, 2011 ESD 112 (February 14, 2011); McPherson, 2000 EAD 33 (October 6, 2000) (no jurisdiction over intra-union fight unrelated to delegate election); Golubovic, P26 (July 21, 1995) (no jurisdiction over unauthorized changes in local union by-laws or giving car to retiring union official); Laszlo, 2011 ESD 159 (March 10, 2011)(no jurisdiction over copyright laws). Accordingly, we DENY these protests.

APPELLATE RIGHTS

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. Any party requesting a hearing must comply with the requirements of Article XIII, Section 2(i). All parties are reminded that, absent extraordinary circumstances, no party may rely in any such appeal upon evidence that was not presented to the Office of the Election Supervisor. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:

Copies of the request for hearing must be served upon the parties, as well as upon the Election Supervisor for the International Brotherhood of Teamsters.  Service may be accomplished by email, using the “reply all” function on the email by which the party received this decision.
