ELECTION APPEALS MASTER

FOR THE INTERNATIONAL BROTHERHOOD OF TEAMSTERS

Protest Decision 2026 ESD 26, was issued on January 6, 2026 (OES Case Nos. P-026-110425 and P-027-110425) by the Office of Election Supervisor (“OES”) and addresses the pre-election protests of Sean O’Brien and Fred Zuckerman.  The OES granted the protest, and an appeal was filed by the Appellants on January 8, 2026.  Pursuant to a Notice of Hearing, a hearing in this matter was scheduled to be held via Microsoft Teams on January 23, 2026 at 10 AM Eastern.  On January 21, 2026, the OES filed its pre-hearing submission explaining that additional investigation into this matter was necessary, the results of which may impact the OES’s determination.  Appellant concurs that the OES should continue its review.

Accordingly, the appeal is REMANDED for further investigation and for the OES to issue a final determination in ESD 26.  The Election Supervisor shall provide an update on the status of its investigation by February 4, 2026.
