INTRODUCTION

Phillip Turner, Local 243’s Secretary-Treasurer, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2025-2026 IBT International Union Delegate and Officer Election (“Rules”) challenging the eligibility of John Perry to run for delegate in Local 243’s delegate election.

Ron Webne, a representative of the Office of the Election Supervisor (“OES”), investigated this protest.

FINDINGS OF FACT AND ANALYSIS

Pursuant to Art. VI, Section 1 (a) of the Rules, to be eligible to run for any Convention delegate, alternate delegate, or International Officer position, one must:

(1)        Be a member in continuous good standing of the Local Union, with one’s dues paid to the Local Union for a period of twenty-four (24) consecutive months prior to the month of nomination for said position with no interruptions in active membership due to suspensions, expulsions, withdrawals, transfers or failure to pay fines or assessments;

(2)        Be employed at the craft within the jurisdiction of the Local Union for a period of twenty-four (24) consecutive months prior to the month of nomination; and

(3)        Be eligible to hold office if elected.

Local 243’s nomination meeting took place on January 10, 2026. Thus, among other requirements, Perry must have been a member in good standing of Local 243 continuously from January 1, 2024, through December 31, 2025, to be eligible to run for delegate.

Turner alleges that Perry is not eligible because he has not been a member in good standing for the entire 24-month period ending in December 2025—the month prior to Local 243’s nomination meeting. See Rules, Art. 1(a)(1).

Turner provided an “Application and Notice for Membership in Local Union No. 243” that was signed by Perry on January 24, 2024, and “Teamster Local 243 Checkoff Authorization and Assignment” signed by Perry on January 25, 2024. The application and checkoff authorization corroborate Turner’s assertion that Perry was not an active member of Local 243 for 24 consecutive months prior to the month in which Local 243’s nomination meeting occurred. This is also corroborated by Perry’s TITAN records. The TITAN record for Perry reflects the date “01-26-2024” under the designation “CKO aut.” It also shows that the first payment of dues Perry made to Local 243 was on March 13, 2024 (by checkoff). Perry does not dispute this.[1]

Accordingly, we find that Perry is ineligible for delegate and GRANT this protest.

APPELLATE RIGHTS

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. Any party requesting a hearing must comply with the requirements of Article XIII, Section 2(i). All parties are reminded that, absent extraordinary circumstances, no party may rely in any such appeal upon evidence that was not presented to the Office of the Election Supervisor. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:

[1] The investigator contacted Perry requesting information related to determining his eligibility including, but not limited to, when Perry became a member of Local 243. He declined to answer at that time. Perry subsequently told the investigator that he was not going to “fight anybody about this” and “I withdraw”.
