INTRODUCTION

Kevin Mayer, a candidate for alternate delegate in the Local 331’s delegate election, filed a protest alleging that he was denied a copy of the worksite list by Erica Rassman, Principal Officer of Local 331 after requesting it.

 

Joe Childers of the Office of the Election Supervisor investigated this protest.

 

ANALYSIS

 

On March 18, 2026, Mayer visited the local to inspect and copy the “company list.” On that day, he was allowed to inspect a list of companies that have contracts with the local but was not allowed to copy the list or make notes. The next day, Thursday, March 19, 2026, Mayer sent an email specifically requesting the “company list.” By March 21, 2026, Mayer filed this protest because he had not received a copy of the worksite list. On Monday, March 23, 2026, after speaking with the investigator, Rassman promptly emailed the “worksite list” to Mayer. Rassman explained that Mayer did not request the worksite list only a company list. She provided the email correspondence with Mayer which corroborated her statements.

 

Rassman was unopposed for the one delegate position. The election was only for one alternate delegate position. The election was held on April 1, 2026. The result was 98 votes for Brian Lyons and 27 votes for Kevin Mayer.

 

         Article VII, § l(b) of the Rules states:

 

Each delegate candidate, each alternate delegate candidate and each nominated or accredited International Officer candidate shall have the right to a current list of all sites, with corresponding addresses, where any and all Union members work. Requests for such worksite lists shall be made to the pertinent Local Union's Secretary-Treasurer or principal officer in writing and shall be honored within five (5) days. Such worksite lists shall be arranged by employer name.

 

Mayer requested a company list not the worksite list. A list of companies is not the same as a list of worksites where Union members work. There may be several worksites for a single employer. Rassman interpreted the Rules strictly by providing inspection of the company list. Nevertheless, after speaking with this investigator, Rassman promptly sent the worksite list to Mayer, which was within 5 days of his request for the “company list.”

 

Accordingly, we DENY this protest.

 

APPELLATE RIGHTS

            Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. Any party requesting a hearing must comply with the requirements of Article XIII, Section 2(i). All parties are reminded that, absent extraordinary circumstances, no party may rely in any such appeal upon evidence that was not presented to the Office of the Election Supervisor. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:

Copies of the request for hearing must be served upon the parties, as well as upon the Election Supervisor for the International Brotherhood of Teamsters.  Service may be accomplished by email, using the “reply all” function on the email by which the party received this decision.
