Re:  Election Office Case No. CONV-4-IBT

 

Gentlemen:

 

James P. Hoffa, a candidate for general president, filed a protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”) against the IBT, as well as the Carey campaign, the slate of candidates led by Ron Carey, candidate for general president.  Mr. Hoffa alleges that on July 14, 1996, the IBT conducted a training meeting for individuals assigned to serve as sergeants-at-arms at which David Eckstein and IBT Associate General Counsel John Sullivan instructed the sergeants-at arms to give preferential treatment to pro-Carey whips attempting to access microphones on the floor of the Convention to discuss changes in the IBT Constitution.

After filing his protest, the protester notified the Election Officer that he wished to withdraw his protest.  Finding that the withdrawal effectuates the purpose of the Rules, the Election Officer permits the protest to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
