Jesus Maqueira, a member of Local Union 572 and candidate for delegate, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2000-2001 IBT International Union Delegate and Officer Election ("Rules"). His protest alleges that Luis Ramos improperly removed campaign literature from a bulletin board at his worksite.

Election Administrator representative Dolly Gee investigated the protest.

Findings of Fact and Analysis

Maqueira states he was informed that Ramos removed unspecified campaign literature from a union bulletin board at Maqueira's worksite, Gate Gourmet, and that Ramos admitted the act at an organizational meeting for contract negotiations held February 6. Maqueira produced no eyewitness to substantiate either the act or the admission.

Ramos denied removing literature or admitting doing so. Moreover, Luis Rosales stated that Ramos did not admit the conduct at the February 6 meeting.

Article VII, Section 11(d) of the Rules preserves for candidates and members the preexisting rights they enjoyed "to use employer or Union bulletin boards for campaign publicity." Campaign postings have historically been permitted on the Gate Gourmet bulletin board.

We find insufficient evidence that Ramos violated this provision of the Rules and therefore DENY the protest.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was

not presented to the Office of the Election Administrator in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
