Chuck Symons, a member of Local 213, and George Saavedra, a member of Local 490 and candidate for western region vice-president on the Tom Leedham Rank and File Power slate, filed pre-election protests pursuant to Article XIII, Section 2(b) of the Rules for the 2000-2001 IBT International Union Delegate and Officer Election ("Rules"). Each challenges the conduct and distribution of videotapes of the September 21, 2001 candidate forum that is the subject of our decision in Candidate Forums, 2001 EAD 428 (August 22, 2001), aff'd, 01 EAM 77 (September 25, 2001). The matters raised by these protests have already been decided in the proceedings before the Election Administrator and the Election Appeals Master that resulted in the above-cited decisions. On that basis, the protests here are accordingly DENIED.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Administrator in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
