ORDER

This matter is an appeal from the Election Supervisor's decision 2006 ESD 55 issued January 26, 2006.

A hearing was held before me on February 8, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. on behalf of the Election Supervisor, David J. Hoffa, Esq. on behalf of Earl Walker, Earl Walker, President of IBT Local Union 614, Barbary Harvey, Esq. and Jeffrey Duncan.

I have received the submissions of the parties and considered the arguments of all those who participated in the hearing.

The decision of the Election Supervisor is affirmed, for reasons set forth in his decision of record, the appeal submission of Jeffrey J. Ellison dated February 7, 2005 and Mr. Ellison's persuasive arguments made at the hearing, particularly those responsive to the documents provided by Mr. Walker the protestor and referenced in Mr. Hoffa's appeals submission dated January 30, 2006.
