ORDER

This matter is an appeal from the Election Supervisor's decision 2006 ESD 111 issued February 27, 2006.

A hearing was held before me on March 3, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. and Steven Newmark, Esq. on behalf of the Election Supervisor, Arden D'Amico, Treasurer of TEAM 639 Slate and Neil Potts, member and Shop Steward of Local 639.

During the argument at the Hearing, the Election Supervisor made clear that references in the Findings of Fact Section of the Decision of record did not constitute a finding, formal or otherwise, explicit or implicit, by the Election Supervisor that Art D'Amico during the course of his tenure as a local union business agent, "had his family in the parking lot and was in a hurry to go on vacation," to the detriment of a union member's grievance rights. I specifically note and formally incorporate this clarification of the Election Supervisor into the Record.

The decision of the Election Supervisor, with the incorporated reference above noted, is in all respects affirmed.
