ELECTION APPEALS MASTER

ELIGIBILITY OF VINCENT IMBROSCIANO, LOCAL UNION 814, Protestor.

ORDER

This matter is an appeal from the Election Supervisor's decision 2006 ESD 138 issued March 13, 2006.

A hearing was held before me on March 22, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. and Steven Newmark, Esq. on behalf of the Election Supervisor, George Daniello, President of Teamsters Local 814 and Vincent Imbrosciano, the protestor.

Mr. Imbrosciano was ruled ineligible to run for alternate delegate. He concedes that he did not make timely payment of his dues, the effect of which was to interrupt the required monthly payments for each month of the 24 month eligibility period. He argues that the Election Supervisor erred in not considering the extenuating circumstances that prevented such payments from being made.

The Election Supervisor argues that under the IBT Constitution and Election Rules he lacks the authority to consider extenuating circumstances on a case by case basis in eligibility cases of the type before us.

It is clear the Election Supervisor does in fact lack such authority. Accordingly, his decision in this matter is affirmed.
