ELECTION APPEALS MASTER

ORDER

This matter is an appeal from the Election Supervisor's decision 2006 ESD 190 issued May 16, 2006.

A hearing was held before me on May 31, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. on behalf of the Election Supervisor, Michael T. Harren, Esq. on behalf of Local Union 118, Chris Toole, Local Union 118 Secretary-Treasurer, Mike LaRocca a member of Local Union 118 and Blair T. Kenny the protester.

The Election Supervisor has made a motion, dated may 25, 2006, to dismiss the appeal for failure of the protester to timely provide a copy of his appeal to the Election Supervisor as required by Article XIII, Section 2(i) of the Election Rules.

The Election Supervisor has made a diligent search of his facilities and reports that no such appeal has been received. The protester at the hearing was unable to provide proof that he had complied with the Rules and sent a copy of the appeal to the Election Supervisor.

Accordingly, the appeal is dismissed and the decision of the Election Supervisor is deemed final and binding.
