ELECTION APPEALS MASTER
IN RE:
LEEDHAM SLATE, Protestor.

This matter is an appeal from the Election Supervisor's decision 2006 ESD 319 issued July 5, 2006.

A hearing was held before me on July 14, 2006. The following persons were heard by way of teleconference: Richard Mark, Esq., the Election Supervisor, Steven Newmark on behalf of the Election Supervisor, Joel Kaplan on behalf of Randy Cammack and Local 63; Gary Miller and Nathan Eisenberg on behalf of Local 89 and Dan Clifton on behalf of the Leedham Slate.

A member of Local 63 assaulted a member of Local 89 in a bar in Las Vegas during the IBT Convention. The Election Supervisor determined that the assault was a response to the victim's expression of political speech, and found a violation of the Election Rules. He ordered that a remedial notice be posted at all work bulletin boards under the jurisdiction of both locals. Local 89 appeals on the ground that the posting requirement is onerous.

This appeal is frivolous and more regrettably, irresponsible.

The decision of the election supervisor is, accordingly, affirmed.
