This matter is an appeal from the Election Supervisor's decision 2006 ESD 337 issued August 10, 2006.
A hearing was held before me on August 18, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. on behalf of the Election Supervisor, David J. Hoffa, Esq. on behalf of Hoffa 2006 and Barbara Harvey, Esq. on behalf of Teamsters for a Democratic Union.
I am in receipt of the decision dated August 23, 2006 of the Honorable Loretta A. Preska, United States District Judge for the Southern District of New York in United States of America v. International Brotherhood of Teamsters, et al.
The appeal in this matter is, accordingly, moot and is dismissed.
