This matter is an appeal from the Election Supervisor's decision 2006 ESD 354 issued September 21, 2006.

A hearing was held before me on October 3, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. and Steven R. Newmark, Esq. on behalf of the Election Supervisor, Bradley T. Raymond, Esq. on behalf of the International Brotherhood of Teamsters, David J. Hoffa, Esq., on behalf of Hoffa 2006 and Daniel E. Clifton, Esq. on behalf of the Leedham Slate.

The issue in this protest case is whether the use of the chair and microphone by Convention Chairman James P. Hoffa in conducting Convention business improperly tolerated partisan attacks upon the Leedham opposition, such that a Union resource, the convention floor, became a vehicle for one-sided campaigning in violation of the election rules.

The Election Supervisor carefully reviewed the documentary and procedural record and concluded that no such violation occurred.

I agree. Accordingly, the decision is in all respects affirmed.
