This matter is an appeal from the Election Supervisor's decision 2006 ESD 379 issued October 24, 2006.

A hearing was held before me on November 2, 2006. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq. and Steven R. Newmark, Esq. on behalf of the Election Supervisor, David Hoffa, Esq. on behalf of the Hoffa 2006 Slate and Tony Andrews, Secretary Treasurer of Local Union 305.

This appeal arises from an inadvertent violation of the Election Rules involving the log maintenance requirement in connection with the maintenance of the campaign literature table at Local Union 305.

Two impressive and equally credible participants in the Election Supervisor's investigation, IBT member Dan O'Keefe and principle officer Tony Andrews of Local 305 describe events related to the presence of Leedham flyers on the literature table during the week beginning on October 11, 2006.

The only issue, not in dispute, is the failure to maintain the required log. The Election Supervisor's remedy is notably mild and does not in any way impugn the integrity or honesty of Mr. Andrews.

Accordingly, the decision is affirmed.
