ELECTION APPEALS MASTER
IN RE: ELIGIBILITY OF JOHN MCPARTLIN, Protestor.

ORDER

This matter is an appeal from the Election Supervisor's decision 2011 EAD 79 issued January 24, 2011. The appeal was submitted by Kenneth Kwapisz, Secretary-Treasurer of Local Union 299.

A hearing was held before me on February 2 2011. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq., for the Election Supervisor; Bill Broberg for the Election Supervisor; David Hoffa, Esq. on behalf of the Hoffa-Hall Campaign; Roger Webb, Esq. on behalf of John McPartlin; and John McPartlin; James Wallington , Esq. on behalf of Kenneth Kwapisz and Kenneth Kwapisz the protester.

During this protracted hearing there was considerable attention given to certain documents of record submitted by Baptiste & Wilder on behalf of Local 299 Secretary-Treasurer Ken Kwapisz who is objecting to the decision of the Election Supervisor finding John McPartlin eligible for nomination as delegate to the IBT Convention. The documents did not impeach the basis of the Election Officer's ruling.

James Wallington of Baptiste & Wilder was invited to submit any supplemental evidence, if any, that might remedy this deficiency. He has submitted a statement of Kwapisz, a declaration of Steven Grahl, and a bates numbered copy of the already submitted documents.

None of this establishes the claim of the appellant, and accordingly the decision of the Election Supervisor is in all respects affirmed.
