ORDER
An appeals hearing in this matter was scheduled for 12:00 p.m. EDT today. The appellant John Lesicko was notified of this hearing time in a scheduling letter sent to him and dated April 1, 2011. Mr. Lesicko did not call into the telephone conference at that hour and accordingly his appeal was dismissed.
Mr. Lesicko later telephoned Ms. Jacqueline Newbey of my staff and stated he failed to call at 12 noon as clearly stated in the notice, because of a typographical error on the time deadline to join the telephone link. The notice said 1 p.m. when it should have said 11 a.m.
Accordingly, the order dismissing the appeal is vacated, and the appeal hearing is rescheduled for Monday, April 11, 2011 at 11:00 a.m.
