ORDER

This matter is an appeal from the Election Supervisor's decision 2011 ESD 197 issued April 4, 2011. The appeal was submitted by Toiale Johnson, a member of Local Union 299 and candidate for delegate on the New Era slate.

A hearing was held before me on April 13, 2011. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq., for the Election Supervisor; Joe Childers, Investigator for the Election Supervisor, John McPartlin, member of Local Union 299 and candidate for delegate on the New Era slate, Robert Baptiste, Esq. for Teamsters Local 299 and Toiale Johnson, the protester.

This appeal asserts the lack of a level playing filed in campaign access because of inaccurate worksite address lists that were provided to the appellate and his slate of candidates.

The Election Supervisor noted inaccuracies in the list, but found no material or substantial interference with the slate's campaign efforts at the worksites. The appellant has provided no basis to reverse those findings, which under the Election Rules are entitled to deference. Accordingly, the decision of the Election Supervisor is affirmed.
