ORDER

This matter is an appeal from the Election Supervisor's decision 2011 ESD 201 issued April 4, 2011. The appeal was submitted by John Phillipenas, a member and secretary-treasurer of Local Union 631 and delegate candidate on the Empowerment slate.

A hearing was held before me on April 13, 2011. The following persons were heard by way of teleconference: Jeffrey J. Ellison, Esq., for the Election Supervisor; Mary Campbell, Investigator for the Election Supervisor, Tommy Blitsch, for the Restore The Pride Slate; Matt Fitch, representative for Merriman River and John Phillipenas, the protester.

This case involved the adequacy of ballot integrity procedures in the delegate election of Local 631.

The appeals issue in the Hearing addressed the decision to count ballots from the second pick-up of ballots from the post office, with the appellant urging five arguments that challenge that decision. The Election Supervisor found no merit in these assertions, and appellant has advanced no convincing basis to reverse the factual findings of the Election Supervisor. Accordingly the decision is in all respects affirmed.
