              ORDER

 

 

 

This matter is an appeal from the Election Supervisor's decisions 2011 ESD 230 issued April 22, 2011.  The appeal was submitted by Robert Hill, member of BLET 758.

A hearing was held before me on May 10, 2011.  The following persons were heard by way of teleconference:  Jeffrey J. Ellison, Esq., for the Election Supervisor, Dolores Hall, Investigator for the Election Supervisor and the appellant.    

This dispute turns upon whether certain union officials posted on union bulletin boards proper information as prescribed by the IBT election rules.

Appellant in this case asserts that he "personally on several occasions throughout the weeks checked on the progress of postings (of election event notices), viewing none at Wisham (Washington) and Pasco (Washington)."  Appeals statement of Robert Hill, undated.

On this basis appellant Hill implied that certain named union officials were neither forthright nor honest in their statements to the Election Supervisor's investigators, and furthermore, that they willfully violated the Election Rules' posting requirements.

Fortunately for the IBT membership, the administration of the international election and enforcement of the Election Rules are carried out by the Election Supervisor under the mandate of the Federal Court in New York, according to law, fact, evidence and scrupulous fairness, and not according to appellant's "suspicious…wonder(ing)."  Appellant Statement.

Accordingly, the decision of the Election Supervisor denying is in all respects affirmed.
