              ORDER

 

 


This matter is an appeal from the Election Supervisor's decisions 2011 ESD 256 issued May 12, 2011 and 2011 ESD 261 issued May 22, 2011.  The appeal was submitted by James Beck, member of Local Union 100.

A hearing was held before me on May 25, 2011.  The following persons were heard by way of teleconference:  Jeffrey J. Ellison, Esq., for the Election Supervisor, Denise Ventura, Investigator for the Election Supervisor, Sam Bucalo, Secretary-Treasurer of Local Union 100, James Beck protester and Sandra Hatfield, a witness on behalf of Mr. Beck.

Appellant asserts that a) slate declaration forms filed in Local 100's delegate election were invalid because they were not signed by the local's secretary-treasurer, were not timely filed, and not properly completed in other respects and b) one of the Local's officers and candidate for delegate had received improper campaign contributions in the form of wages paid to him by his employer UPS and his local.

These appeals border on the frivolous.  The Election Supervisor's decisions on both protests are so clear, so convincing and so fair-minded, that no responsible challenge can be made to them.

 

These decisions are accordingly in all respects affirmed.
