IN RE:  MICHAEL DAILEY,

              ORDER

 

 

This matter is an appeal from the Election Supervisor's decision 2011 ESD 271 issued June 1, 2011.  The appeal was submitted by Michael Dailey and Alex Spangenberg.

A hearing was held before me on June 14, 2011.  The following persons were heard by way of teleconference:  Jeffrey J. Ellison, Esq., for the Election Supervisor, Michael Dailey and Alex Spangenberg, the protesters.

The final delegate strength calculation for Local 71 resulted in its elected delegate delegation to the IBT Convention being reduced from 4 to 3, resulting in the elected delegate with the lowest vote total, Dailey, being disqualified from service at the Convention.  On appeal Dailey argues that the delegate reduction recalculation was rendered on an untimely basis by the Election Supervisor and therefore is invalid.  He asks that he be permitted to serve as a Convention delegate.

The Election Supervisor's Appeals Chief Jeffrey Ellison persuasively argued during the hearing that his office met the time requirements as set forth in the Election Rules.

Accordingly, the decision of the Election Supervisor is affirmed.
