ORDER RE 2020 ESD 15

 

Protest Decision 2020 ESD 15, issued on September 1, 2020, addressed a protest by Jose Perez, a member of Local 769, alleging that Local 769 business agent Dan Vera impermissibly interfered with campaigning by Mr. Perez and another member on behalf of the O’Brien-Zuckerman 2021 slate and caused or contributed to the decision of UPS contract security to remove them from the parking lot.

On September 3, 2020, Local 769 appealed the decision imposed by the Election Supervisor and requested a stay of the remedy pending resolution of the appeal.  On September 3, 2020, the Election Supervisor submitted a written response opposing the requested stay and, that same day, the Election Appeals Master denied the stay.  By Notice of Hearing, the Election Appeals Master scheduled a telephonic hearing for September 10, 2020.[1]

On September 9, 2020, counsel for Local 769 submitted an e-mail to all interested parties withdrawing the appeal.  On September 9th, the Office of Election Supervisor, by reply e-mail to all interested parties, stated that it had no objection to the withdrawal and indicated that the withdrawal was consistent with the purposes of the Rules.

Appellant, having submitted an application in writing to withdraw its appeal of ESD 15, and having heard no objection from any party, the application is hereby GRANTED.  The appeal is deemed WITHDRAWN.
