Eligibility of John R. Cetinske to Run for Delegate

Teamsters Local Union 480

 

Gentlemen:

 

Pursuant to Article XIV, Section 2(b)(1) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules), John R. Cetinske, a member of Local Union 480, protested, by letter to the Election Officer, a determination made by Local Union 480 that he was ineligible to run for office in the local unions upcoming officer election.  The Election Officer has determined that the subject of this protest, eligibility to run for office in a local union election, is outside her jurisdiction, and thus, fails to state a claim for which the Election Officer may provide a remedy.[1]  Accordingly, the protest is DISMISSED.

 


Any  interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of  receipt of  this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was John R. Cetinske

not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:

[1]The protester is also a candidate for delegate to the International convention.  The Election Officer has determined that the protester is eligible to run for delegate and has  communicated this finding to Mr. Cetinske in a notice dated October 3, 1995.
