Gentlemen:

 

In response to a request to verify eligibility, the Election Officer, by letter dated March 4, 1996, informed Philip John that he was ineligible to run for delegate or alternate delegate to the International convention.  By letter received by the Election Officer on March 13, 1996,  Mr. John protests the Election Officers determination.

 

On March 4, 1996, Local Union 743 held its nomination meeting.  Mr. John was not nominated to be a delegate or alternate delegate, nor did he nominate or second the nomination of any candidates.  Since the deadline for nominations in Local Union 743 has passed, the issue raised in this protest is moot and the protest is DENIED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
