Protest Decision 2005 ESD 22

On October 25, 2005, we issued our decision in this case. Bundrant, 2005 ESD 19.

The IBT timely appealed our decision to the Election Appeals Master on October 27 and requested that we stay our decision pending resolution of that appeal. The request for stay was served on interested parties by email, and no objection has been lodged.

Finding that no party will suffer substantial prejudice thereby, we STAY our decision in 2005 ESD 19 until the pending appeal is resolved.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal and shall be served upon:

A copy of the protest must accompany the request for hearing.
