Duane Darling, member and delegate candidate from Local Union 135, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2005-2006 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that he was denied access to employee parking lots at UPS's 16th Street facility in Indianapolis, in violation of the Rules.

Election Supervisor representative Joe Childers investigated this protest.

Findings of Fact and Analysis

The protestor alleged that when he went to UPS's 16th Street facility in Indianapolis on January 25 to campaign, a security guard directed him to leave the premises after he had been present only 15 minutes. This protest followed.

Through the efforts of our representatives and counsel for UPS, management at the facility in question was advised of the parking lot campaign rights of Article VII, Section 12(e) of the Rules. Darling subsequently campaigned at this UPS facility without interference from the security guard who previously had directed him to leave the premises.

Accordingly, we deem this protest RESOLVED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal and shall be served upon:
