In Misich, 2006 ESD 323 (July 8, 2006), we found that UPS had violated the Rules and ordered that it complete a remedy for that violation. On July 10, 2006, UPS appealed our decision. A hearing on the appeal is scheduled for July 18, 2006. On July 12, 2006 UPS requested, via email, that we stay our decision pending the outcome of the appeal.
We GRANT UPS's request and STAY our decision pending the outcome of the appeal before the Election Appeals Master.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal and shall be served upon:
