IN RE: LUPE JUAREZ, Protestor
Protest Decision 2010 ESD 13
Issued: August 4, 2010
OES Case No. E-002-072610-FW

Lupe Juarez, member and delegate candidate from Local Union 948, timely filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that Sylvia Lovato was not eligible for alternate delegate in Local Union 948's delegate and alternate delegate election because she failed to provide the last four digits of her social security number on her written acceptance of nomination.

By email received August 3, the protestor requested to withdraw the protest.

We find that the withdrawal request effectuates the purposes of the Rules. Accordingly, we deem this protest WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal.
