Mike Webb, member of Local Union 391, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that the local union violated the Rules by placing candidate literature tables in the auditorium of each of its 3 halls rather than in the lobby.

Election Supervisor representative Peter V. Marks, Sr., investigated this protest.

Findings of Fact and Analysis

Article VII, Section 7(h) of the Rules requires each local union to "establish a literature table and/or bulletin board in a public area of each local union facility which is open to members" for distribution of candidate literature. Our Advisory elaborates on the "public area" requirement, stating that "[f]or most locals this will be in the lobby or reception area."

Local Union 391 exceeds 8,000 members and maintains 3 local union halls across North Carolina. When it filed with us its local union plan for the delegates and alternate delegates election, it proposed to place the literature tables required by the Rules in the auditorium of each of its halls. No comment was received on this proposal and we approved it.

Protestor Webb now complains that locating the literature tables in the auditoriums of each facility makes it unlikely that members will see the literature there except during meetings. As such, members coming to the hall for routine union business will not receive the benefit for which the tables are established.

During our investigation of this protest, the local union agreed to move the literature table in each hall to the entrance lobby that members routinely use to access that building. On this basis, we deem the protest RESOLVED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
