Protest Decision 2011 ESD 81

Fred Gegare, member of Local Union 662 and candidate for IBT General President, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). On January 10, 2011, OES issued a Statement on Review of Candidate Accreditation Petitions, finding that Gegare submitted insufficient valid petition signatures to achieve status as an accredited candidate under Article X of the Rules. The protest alleged that OES's determination violated the Rules because it improperly voided signatures and petitions which, if found valid, would have resulted in Gegare's accreditation.

On January 23, 2011, Gegare requested to withdraw the protest. We find that permitting withdrawal of the protest is consistent with the purposes of the Rules. Accordingly, we deem this protest WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
