Vernon Gammon, member, secretary-treasurer, and delegate candidate in Local Union 391, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that the New Generation slate conducted a campaign mailing to local union members without using the procedure for such mailings established by the local union election plan.
Election Supervisor representative J. Griffin Morgan investigated this protest.
Investigation showed that the mailing was conducted using the mailing list OES provided to the campaign of General President candidate Sandy Pope in accordance with Article VII, Section 3 of the Rules. Such use of the mailing list does not require the campaign to utilize the procedures for mailings set by local union election plans.
On February 18, protestor Gammon requested to withdraw this protest. We find that permitting withdrawal of the protest is consistent with the purposes of the Rules. Accordingly, we deem this protest WITHDRAWN.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
