Angel Garces, member of Local Union 854, filed a pre-election protest pursuant to Article XIII, Section 2 of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that Local Union 854 distributed union-funded campaign literature entitled "Daniel Gatto Gets Justice for Kimberly Sessions" that lauds the efforts of local union president Dan Gatto in challenging Sessions' termination from employment. Gatto was nominated for delegate on a slate that includes incumbent local union officers. Sessions was nominated for alternate delegate on a slate opposing Gatto's slate. The protest alleged that the local union publication was distributed to influence the election of delegates and alternate delegates, in violation of the Rules.
In addition to Sessions, two other candidates, Gary Ham and protestor Garces, were nominated in opposition to Gatto's slate. In Eligibility of Ham, et al, 2011 ESD 138 (February 25, 2011), appeal pending, we found Ham ineligible for nomination as delegate and ineligible to nominate Sessions and Garces. As a result of our decision, the candidates nominated on Gatto's slate were unopposed and thereby deemed elected.
Accordingly, we DENY this protest as MOOT. In the event our decision in Eligibility of Ham is reversed, we will reopen this matter.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the bnasis for the appeal, and shall be served upon:
