IN RE: ELIGIBILITY OF DUSTIN FAVOR, Allied Federation.
Protest Decision 2011 ESD 160
Issued: March 10, 2011
OES Case No. E-043-030311-SO

Dennis Albers, general chairman of Allied Federation, BMWED, filed an eligibility protest pursuant to Article XIII, Section 3 of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that Dustin Favor, an elected delegate, is no longer eligible to serve as delegate since he has resigned from his position as a union officer and is currently a supervisor with Union Pacific Railroad.

By email transmitted on March 9, 2011, Albers requested to withdraw the protest.

Finding that permitting withdrawal is consistent with the purposes of the Rules, we deem this protest WITHDRAWN.

In advance of the June 2011 IBT convention, we will examine all elected delegates and alternate delegates to insure they are eligible to serve.  In the event any elected delegate or alternate delegate is found at that time to be ineligible for office, that person will not be issued convention credentials and will be replaced by the ranking alternate delegate.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
