Gary Fabiano, member of Local Union 107, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2010-2011 IBT International Union Delegate and Officer Election ("Rules"). The protest alleged that the U.S. Postal Service interfered with Fabiano's right to observe the pickup of ballot packages returned as undeliverable.
Election Supervisor representative Denise Ventura investigated this protest.
Findings of Fact and Analysis
Ballots in the delegates election at Local Union 107 were mailed on February 15 and counted on March 9, 2011. In previous decisions, we have addressed issues concerning observer rights.[1] In this protest, Fabiano alleged that when at the post office on February 28 to observe the pickup of undeliverables he was confronted by postal inspectors who told him he was trespassing because he was not a P.O. box holder and had no right to be there.
Fabiano contacted OES representative Ventura, who in turn contacted the postal service to explain that Fabiano was present as an observer of an election. This information apparently satisfied the postal service, and Fabiano was able to observe the pickup of undeliverables on subsequent dates without threat of confrontation, citation, or arrest.
On this basis, we deem this protest RESOLVED.
Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within two (2) working days of receipt of this decision. The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Supervisor in any such appeal. Requests for a hearing shall be made in writing, shall specify the basis for the appeal, and shall be served upon:
