                                                                        )           Issued: February 16, 2016

Protestor.                                           )           OES Case No. P-162-021116-NE

____________________________________)

Jeffery Scaglia, member and delegate candidate in Local Union 118, filed a pre-election protest pursuant to Article XIII, Section 2(b) of the Rules for the 2015-2016 IBT International Union Delegate and Officer Election (“Rules”).  The protest alleged that Local Union 118 failed to produce a current list of all employer worksites under the jurisdiction of the local union, in violation of Article VII, Section 1(b) of the Rules.

Promptly after the protest was acknowledged by our office, protestor Scaglia received the requested list.

By email dated February 12, 2016, the protestor requested to withdraw the protest.  Finding that withdrawal serves the purposes of the Rules, we deem this protest WITHDRAWN.
