Gentlemen:

 

A pre-election protest was filed pursuant to Article XIV,  Section 2 (b), of the Rules for the 1995-1996 I.B.T. International Union Delegate and Officer Election (Rules) by Gary L. Gregory, a member of Local Union 135 and a candidate for delegate.  In his protest, Gregory contends that Local Union 135 has failed to comply with his written request of June 9, 1995 to provide a list of work sites and to inspect the collective bargaining agreements covering members of the local union.

 

The Election Officer has been advised that Gregory was mailed a worksite list on June 16, 1995.  On June 19, 1995,  Gregory was advised that he could examine the collective bargaining contracts during normal business hours.

 

Gregory confirmed that he had received the worksite list and is aware that he will be permitted to examine the collective bargaining contracts whenever he makes arrangements with the Local Union.  Under these circumstances, the Election Officer concludes that further processing of this protest is unwarranted. Gregory’s complaints as contained in this protest have been addressed, and the relief he requests has been achieved.  Accordingly, the protest is now RESOLVED.

If any interested party is not satisfied with this determination, they may request a hearing before the Election Appeals Master within one day of their receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
