Gentlemen:
A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Officer Election (“Rules”) by Jerry Halberg, a member of Local Union 174. The protester alleges that Local Union 174 Secretary-Treasurer, Robert A. Hasegawa, refused to allow the protester, a candidate for delegate, to view a side letter to a current collective bargaining agreement between K & L Beverages and the Local Union. Mr. Halberg now advises the Election Officer that he wishes to withdraw his protest. The Election Officer, finding that such withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.
