Re:  Election Office Case No. P-121-LU710-CHI

 

Gentlemen:

 

A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Elections (“Rules”) by Timothy Casey, a member of Local Union 710.  In his protest, Mr. Casey contends that Frank J. Wsol, secretary-treasurer of Local Union 710 and James Ramirez, president of Local Union 710 and the entire executive board of Local Union 710 violated the Rules when Mr. Wsol refused to read Local Union bylaw proposals submitted by Mr. Casey and his “political group” at a special Local Union membership meeting held on August 6, 1994.

 

In response to the protest, Local Union 710 contends that the protest relates solely to a proposed amendment to Local Union 710 bylaws and does not relate in any way to the International Union delegate and officer elections.  As to the merits of the protest, the Local Union states that the amendments proposed by Mr. Casey were deferred and will be read at the  membership meeting scheduled for September 24, 1995.

The protest was investigated by Regional Coordinator Julie Hamos.

 

The actions protested relate solely to amendments of the Local Union bylaws concerning an increase in Local Union initiation fees, the creation of an out-of-work benefit fund, and a special assessment to pay for the fund and setting September as the month for the Local Union officer elections. 

 

“Pursuant to the Consent Order, the Election Officer has the authority to supervise all phases of the International Union delegate and officer election . . .”  Rules, Article I.  The jurisdiction of the Election Officer does not extend to matters pertaining to Local Union bylaws or Local Union elections.  There is no dispute that the actions protested relate solely to the amendment of Local Union bylaws.  Accordingly, the protest is DENIED.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
