A pre-election protest was filed pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Officer Election (“Rules”) by Dan F. Darrow, secretary-treasurer of Local Union 348, and the Executive Board of Joint Council 41. They contended that the preparation and distribution of a formal constitutional determination by General President Ron Carey on November 17, 1995 violated the Rules. The charging parties now advise the Election Officer that they have reached an accord and settled the dispute with the IBT regarding the subject matter of the protest. The Election Officer, finding that such withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.
