Re:  Election Office Case No. P-427-LU421-MOI

 

Gentlepersons:

 

A pre-election protest was filed pursuant to Article XVI, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules ”) by David J. Schroeder, a member of Local Union 421.  Mr. Schroeder alleges that Dennis Schlegel,

Kay Petitgout, and Jean Dunwoody were improperly nominated as alternate delegates.

 

The protester asserts that these nominations were improper because the documents constituting the written nomination, second, and acceptance of the candidates did not contain their telephone numbers or addresses.

 

This protest was investigated by Regional Coordinator Michael D. Gordon. 

 

The option to nominate, second, and accept nominations in writing is set forth in the Rules at Article II, Section 5(f) and (g).  A nominator, seconder, or a member accepting a nomination is not required to place his or her telephone number or address on the written documents allowed by the Rules

 

For the foregoing reasons, the protest is DENIED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
