Gentlemen:

 

Christopher Courter, a member of Local Union 278, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules).  The protester alleged that Local Union 278 Secretary-Treasurer Jack Bookter, a member of the Members First slate of candidates, violated the Rules by retaliating against the Teamsters for Ron Carey slate for filing the protest docketed as P-412-LU278-CSF.  The protester also alleges that Mr. Bookter violated Article VII, Section 5(a)(3) of the Rules by refusing to hold a delegate candidates forum at a Local Union 278 general membership meeting without providing notice to the candidates.

 

              Mr. Courter now advises the Election Officer that he wishes to withdraw his protest.  The Election Officer, finding that the withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
