Re: Election Office Case No. P-586-LU24-CLE

 

Gentlemen:

 

Terry Maxwell, a member of Local Union 24, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (“Rules”).  The protester alleges that campaign literature for one slate of candidates for delegate was posted on a union bulletin board at an employer work site, while no other slates were allowed access to this bulletin board, in violation of Article VIII, Section 11(d).

 

Regional Coordinator Joyce Goldstein investigated the protest.

 

The objectionable material has been removed from the bulletin board, and another bulletin board has been installed by the employer for campaign materials during the election process.  Mr. Maxwell has stated that he is satisfied with this result.

 

Accordingly, the protest is RESOLVED.

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
