Re:  Election Office Case No. P-734-LU385-SEC

 

Gentlemen:

 

Les Jackson, a member of Local Union 385, filed a pre-election protest pursuant to Article XIV, Section 2(b) of the Rules for the 1995-1996 IBT International Union Delegate and Officer Election (Rules).  The protester alleges that John Wright, a manager at Consolidated Freightways, issued a warning notice to him for absenteeism in retaliation for his support of the candidacy of James Hoffa.

 

Consolidated Motor Freight has agreed to modify the warning notice to remove references to those dates when Mr. Jackson was unavailable for work because he was involved in union business.  Based on this modification, Mr. Jackson has agreed to withdraw the protest.

 

The Election Officer, finding that such withdrawal effectuates the purpose of the Rules, permits the protest to be WITHDRAWN.

 

Any interested party not satisfied with this determination may request a hearing before the Election Appeals Master within one day of receipt of this letter.  The parties are reminded that, absent extraordinary circumstances, no party may rely upon evidence that was not presented to the Office of the Election Officer in any such appeal.  Requests for a hearing shall be made in writing and shall be served on:
